MEMORANDUM OF UNDERSTANDING
Between the judiciary of Pakistan and the judiciary of
Azad Jammu and Kashmir on cooperation in judicial sector


          WHEREAS, the Government of Pakistan in discharge of its responsibilities under the UN Resolution, has not guided and assisted for establishment of the institutions in Azad Jammu and Kashmir for better governance and administration but also brought Azad Jammu and Kashmir into mainstream in all spheres of life like any province of the federation;
            AND WHEREAS, in Pakistan and Azad Jammu and Kashmir the laws relating to the administration of justice are almost identical having common features and similarities and the system of justice is also identical and similar;
            AND WHEREAS, in the new era, as a result of unprecedented lawyers, media and civil society’s movement , the judiciary as an institution has emerged as beacon of light for the people’s hopes. To achieve the goal of speedy and effective justice for all, the judiciary in Pakistan under the leadership of the Chief Justice of Pakistan /Chairman National Judicial (Policy Making) Committee has developed a mechanism to function as one organ and in this regard the National Judicial (Policy Making) committeehas played an effective role;
            AND WHEREAS, The Chairman and the members of the national judicial (policy making) committee in furtherance of desire and wishes of the chief justice of Azad Jammu and Kashmir, have been pleased to associate the judiciary of Azad Jammu and Kashmir in the National Judicial (Policy Making) committee;
            AND WHEREAS, though the judiciary of Pakistan and that of Azad Jammu and Kashmir have been mutually benefited from their experiences and such informal participation provided a forum for sharing experiences and exchange of ideas, resulting in mutually beneficial relationship between the two judiciaries but it is felt necessary that for effective administration of justice and further strengthening the institutional relationship, some mechanism needs to be evolved;
            THEREFORE, the judiciary of Pakistan and the judiciary of Azad Jammu and Kashmir on this day 7th September, 2013, have signed the Memorandum of Understanding and identified the following areas of cooperation:

  1. Strengthening the services delivery component of judiciary through coordination and harmonizing judicial policies within existing legal framework.
  2. Enhancing the capacity and performance of justice sector institutions through monitoring.
  3. Setting up performance standards for judicial officers and persons associated with performance of judicial and quasi-judicial functions;

The judiciary of Pakistan and the judiciary of Azad Jammu and Kashmir shall use the forum of National Judicial (Policy Making) committee to achieve the above objectives with bilateral co-operative activities which may include but shall not be limited to:-
           

  1. Supporting initiatives to ensure expeditious and inexpensive dispensation of justice;
  2. Promoting bilateral actions to enhance the functionality of formal justice system;
  3. Encouraging opportunities for co-operation at all levels of judiciary to share experiences and best practices for taking benefit of the same;
  4. Promoting the use of information technology to foster monitoring mechanism of the justice sector institutions;
  5. Creating networks and exchange of information for evolving strategies to expedite trial proceeding to restore the confidence of people in the formal justice system; and
  6. Developing outreach capabilities, including meetings to discuss issue of common concern.
